Litigation Department Wins School District First Amendment Case, Overtime Wage Hour Claim for Gas Station Workers
Drake Loeb PLLC's litigation team recently won two important cases for clients in federal court.
Adam L. Rodd and Alana R. Bartley were recently successful in defending the Poughkeepsie Central School District in federal court against a First Amendment suit brought by a superintendent following his dismissal. The Court agreed with the team's Motion to Dismiss which argued that statements made by a public official in his official capacity and pursuant to his job duties are not protected under the First Amendment; Instead, to receive protection, an individual must be speaking as a private citizen. All federal claims were dismissed against the District.
Adam L. Rodd was also successful in a recent wage and hour case, winning a six figure judgment in favor of his clients - several gas station cashiers and clerks who sued their employer for failure to pay them overtime wages for hours worked in excess of forty hours in a work week. Overtime and wage issues are a special area of concentration for Mr. Rodd and his associate Alana R. Bartley. In fact, a recent wage and overtime suit filed by Ms. Bartley on behalf of former Popeyes' employees recently made headlines in the Times-Herald Record.
